Marriage in the Courts

Several judges have stated the value of marriage to society in their court deliberations. We are including links to some of these writings, as well as the Marriage Law Foundations' amicus briefs, to help make the case for defending marriage as the union of one man and one woman:

On September 18, 2007, the Maryland Court of Appeals overturned a lower court's decision, thereby upholding marriage:

The United States Court of Appeals for the Eighth Circuit on July 14, 2006 reinstated a Nebraska voter-passed marriage protection initiative which had been previously overturned by a lower court:

The Georgia Supreme Court upheld a state constitutional marriage amendment, in July 2006, reversing a lower court:

In the summer of 2006, the New York Supreme Court rebuffed the attempt of 44 same-sex couples to overturn the state's marriage law:

The Massachusetts Supreme Judicial Court repelled a challenge to a state constitutional marriage amendment:

Louisiana's Supreme Court overturned a lower court, which had nullified an election passage of a state constitutional marriage amendment:

The Oregon Supreme Court nullified illegal same-sex "marriages" allowed previously by Multnomah County:

Nine same-sex couples, Basic Rights Oregon, and the American Civil Liberties Union v. the State of Oregon and its Governor, the Attorney General, the Director of the Department of Human Services, and the State Registrar

The California Supreme Court unanimously disallowed San Francisco Mayor Gavin Newsom's unlawful decision to allow same-sex "marriages":
