MARRIAGE AND THE LAW: A Statement of Principles

Institute for American Values and Institute for Marriage and Public Policy

This is destined to be one of the most important documents in the effort to defend traditional marriage, not just in the United States, but internationally. Over a hundred of the top family scholars and legal scholars in the U.S. and Canada have drafted this 43 page analysis of the problems being created by the approach to marriage and family law being taken by much of the legal establishment. These problems, they conclude, are being created by the view of too many judges and lawyers that marriage is merely "a creature of the statute and a set legal benefits created by the law" and that traditional marriage is "just one of many equally valid lifestyles." Instead, these experts stress that marriage and the benefits that flow from it is much more than a creation of law. For society to enjoy these benefits it must create a "marriage culture." Doing that "requires the combined efforts of civil society—families, faith communities, schools, neighborhoods, public policy and the law."
